Booking Terms and Conditions for Dog Boarding

By signing, or otherwise contracting the services of Barker & Bone House Ltd (hereafter called us/we) and any of our hosts you (the dog(s) owner) understand and agree that you: have read and understood and accept this agreement, are legally bound by its terms which may be changed without further notice, have provided information which is complete, true and correct and that you understand and agree to the following: |

1. If the dog(s) shows aggression, is uncontrollable or becomes a nuisance beyond reasonable control, he/she may (without notice) be placed either with a different host (if available) or a boarding kennel for the remainder of the stay. You will be liable for kennel fees and a £30.00 transport charge, payable at the end of the stay, or may be taken from the credit card on file. |

2. Unless you otherwise indicate in writing to us before the stay, you acknowledge and agree that the dog(s) may encounter and be allowed to interact and play with other dogs, cats and other pets and with people including children, and you agree that animals are unpredictable and that there is a possibility of injury to the dog(s) and to another animal or a person. |

3. To the maximum extent permitted by law, you hereby release us, our officers, directors, shareholders, employees and agents including each carer, from any and all liability for any injury or illness suffered by your dog(s) while in our (hereafter, by our/we/us we mean Barker & Bone House and our carers) care, except to the extent such illness or injury is the direct result of our negligence or intentional misconduct, and you agree not to initiate any legal proceedings against us with respect to such released claims. |

4. We may refuse to provide dog care, for any reason in our sole and absolute discretion. |

5. You will ensure the dog(s) vaccinations are in date and supply a copy of the vaccination record, before the stay. |
|
6. You will ensure the dog(s) worm/flea treatments are up to date for the stay and that the dog(s) are free of fleas ticks worms and other insects and parasites to the best of your knowledge. |
|
7. Prior to the stay, you agree to supply us with completed handover forms, written confirmation of any changes to the booking form and any other information necessary for due and satisfactory performance of the services and wellbeing of the dog(s). 8. You agree to provide written confirmation from your vet that the dog(s) will be treated by them in your absence and they agree that you will be billed directly. |

9. You will supply sufficient appropriately packaged and labelled food and medication, toys, collar, lead and bedding in a clean and safe condition. |
|
10. Dogs are never allowed off the lead unless specific written instructions are given to the contrary. |
|
11. Your emergency contacts have full authority to make decisions for all aspects of the dogs care. |
|
12. You give us authorisation to care for, administer medication and make decisions on your behalf relating to the heath and general wellbeing of the dog(s) named and for the duration stated on this booking form. |
|
13. We will receive full payment for the stay prior to the stay* and at the end of the stay you will provide full and prompt payment of any additional charges applied or expenses incurred by us* (*If the stay is longer than 3 weeks a separate agreement will be worked out). |

14. You agree that any overages for a late pickup or drop-off in excess of that reserved and/or prepaid, will be paid immediately upon your return. 15. If we have to return to reattempt collection or delivery of the dog(s) you will incur a charge of £25.00 per attempt, plus an hourly boarding charge of £5.00 per hour per dog up to 4 hours and thereafter the normal daily rates will apply. If no hosts are available to care for dog(s) in this situation we may be forced to place the dog(s) in kennels and pass any expenses on to you. |

16. You will not directly hire or engage any of our carers for boarding or related services while the carer is under contract with us and for a period of two years following termination of a carers contract with us. This includes you and any referral of our hosts and/or services from you to a third party. You acknowledge that to do so would violate our carers exclusive contractual agreement with us and may result in legal action being taken against you. |

17. We will provide services with reasonable care and skill and as far as possible, in accordance with your instructions, however, we have no liability to you for any loss, damage, cost, expense or other claims for compensation arising from anything done by us or the dog(s) at the request of, or with the consent of the owner or from any instructions supplied by the owner which are incomplete, incorrect, inaccurate, illegible or late, or any other fault of the owner of the dog(s). |

18. We are fully insured with a reputable company who specialise in insuring pet care businesses like us, for combined liability, professional indemnity and employers liability. Full details are available on request. |

19. You understand the carer is an independent contractor and is not an employee of ours. We do vet our carers thoroughly to ensure that to the best of our knowledge they will provide a suitable loving caring environment for your dog(s), however we are obviously unable to make any guarantee regarding this service. You acknowledge that you have had the opportunity to meet the host, inspect their premises and make inquiries as to the quality of care to be provided before approving the host as suitable and that if you elects to choose your host for you, no claims will be entered into. |

20. Without limiting the above paragraph, we and all our carers aggregate liability for failure to perform under this agreement or any injury or illness to a dog will be limited to the lesser of the cost of the stay during with the failure, injury or illness occurred or £250.00. In no event will we or any of our carers be liable for special, consequential, exemplary or punitive damages, even if advised of their possible existence. |

21. You will indemnify, defend and hold us and our carers harmless from and against any and all losses, liabilities, damages, fines, penalties and expenses (including legal fees) arising from or resulting from any breach of the representations, warranties or covenants contained in this agreement. |

22. The terms of this agreement will govern any booking form or other document relating to the services to be provided by us and any of our carers. |
|
23. Any carer providing services to you will be deemed to be a third party beneficiary of all applicable provisions of this agreement. |
|
24. We will be deemed to have accepted this agreement without execution, upon the earlier of our acceptance of a booking or payment for services to be provided hereunder, or the commencement of the actual provision of services hereunder, subject to our right to refuse services to any person or animal. |
